Brazil Expansion Advice
Who needs a Brazilian work permit or visa?
Anyone who isn’t a Brazilian citizen, or who doesn’t permanently live in the country, will need a permit to work and live in Brazil.
Like many countries, Brazil has many different visas and permits available. Alongside a work permit, foreign nationals will require a Residency permit. Employees will need to obtain both if they want to start working in the country legally.
Brazil’s economic policy aims to attract skilled professionals to contribute to key sectors, plugging skill gaps in the country’s economy and increasing the competitiveness of existing Brazilian companies. In most cases, it is more likely that Brazil will grant temporary visas than permanent ones providing longer-term stays.
What types of Brazilian work permits and visas are there?
Although there are a number of permits and work visas available, there are only three permits relevant to employees seeking work in the country:
- VITEM II – Brazil requires foreign nationals to obtain work visas if they are visiting the country on a business trip – employees can work in Brazil without taking any money from Brazilian companies for up to 90 days per year
- VITEM V – the most common visa issued to workers in Brazil, the VITEM V visa allows for a Brazilian company or an international company with a presence in the country on a temporary basis.
- Visto Permanente (Permanent Work Visa) – available to managers, directors, scientists and select investors – workers who obtain a VITEM V first will become eligible for a permanent visa after two years.
How do I apply for a Brazil work permit or visa?
Before applying for a work visa, employees must obtain a Residency visa. Once acquired, they can then apply for work.
As the VITEM V is the most common work visa, the requirements for a work permit are as follows:
- A valid passport (valid for at least 6 months)
- One passport-style photo (3x4cm in colour, taken within 6 months of application date)
- A completed visa form receipt (signed by the passport holder)
- Original birth certificate
- Police record
- Proof of employment
- Proof of financial means for the duration of the stay
- Work contract documentation
The application is submitted to the Ministério da Justiça (Ministry of Justice and Public Security in Brazil) by the sponsoring company or business on behalf of the employer. Paperwork for the visa is submitted online, but it is still necessary to bring a printed copy upon entering the country. All documents must be apostilled before they are submitted.
The requirements outlined above are only the minimum obligations. However, the application process may differ depending on the visa type, country of origin, and the individual business.
How much does a Brazilian work visa cost?
The cost of a Brazilian work permit is largely dependent on the native country of the ex-pat. For example, the required cost for a visa for a US citizen is roughly $290 (~£228), but the fee for a UK citizen is $225 (~£177). Fees can also change depending on the type of visa you are applying for, the length of your stay, and the location of your application – applying for a visa in-country is usually cheaper than applying abroad.
Why use a PEO partner to obtain a Brazilian work permit?
Since the visa application process is different for each individual, the risk of non-compliance is significantly greater for those who submit their application independently. Once the application has been submitted, additional duties such as payroll, tax, national insurance, and employment contracts need to be considered, which can cause further delays to your international expansion.
Working with a PEO partner can save you time, money, and stress throughout your application process. Here at Leap29, our experts take care of the legal legwork, so you and your business can continue your international expansion without the worry of non-compliance.
