Contract Types

Contracts in Turkey can be indefinite or fixed term which cannot be renewed. Contracts are often governed by a Collective Bargaining Agreement (CBA).

Probation

Probation is usually 2 months which cannot be extended.

Working Hours

Hours can be a maximum of 45 hours per week, which should be divided equally between the days worked with a maximum of 11 hours per day.

Overtime

All hours worked above 45 per week should be paid as overtime at a rate of 150% of usual pay. This may increase in accordance with a Collective Bargaining Agreement. Alternatively, time off in lieu may be given at a rate of 150% of the hours worked. The maximum overtime allowed per year is 270 hours. Any overtime worked during weekends or public holidays should be remunerated at a rate of 200%.

Other

There are no 13th month salary requirements, or other compulsory bonuses, but some companies do provide them. A remote working agreement must be provided in addition to the contract where appropriate.

Corporation tax: 25%

30% for Financial Services

Consumption tax: 20%

Employers’ Social Security: 20.50%

Other Mandatory Contributions: Unemployment 2%

Employees’ Social Security:

14% plus 1% unemployment contribution.

There is a social se­curity ceiling of TYL 75,060

Income tax rates

  • Up To 70,000 TYL – 15%
  • 70,000 to 150,000 TYL – 20%
  • 150,000 to 550,000 TYL – 27%
  • 550,000 to 1,900,000 TYL – 35%
  • Over 1,900,000 TYL – 40%

Notice

The notice period is dependent on the employee’s length of service:

  • No notice is required during probation
  • Less than 6 months’ service 2 weeks’ notice is required
  • With 6 months to 18 months’ service 4 weeks’ notice is required
  • From 18 months to 3 years’ service the requirement is 6 weeks’ notice
  • Over 3 years’ service attracts 8 weeks’ notice

After 6 months’ service employers (with more than 30 employees) must have a valid reason for termination, which can include operational reasons, to which special rules apply. In practice employees can be terminated by mutual agreement which would usually involve an additional severance payment. In such cases employees must be informed that they have no right to reinstatement and that they will not be eligible for unemployment benefit.

Severance Pay

Severance is payable after one year’s service at the rate of one month’s salary per year worked in addition to payment for leave which has been accrued and not used, together with any bonuses owing. There is a ceiling for severance pay which in 2024 is TRY 35,058.58 per month.

*Muslim holidays move forward by 11 days each year and dates are tentative as they are subject to sighting of the moon. It is common for firms to more days over the Muslim holidays.

Leave entitlement is dependent on service:

  • 1-5 years: 14 days
  • 5 – 15 years: 20 days
  • Over 15 years: 26 days

All employees over the age of 50 are entitled to a minimum of 20 days.

Sick Leave

After 3 days employees receive sick pay from Social Security, though many employers will pay full wages from day one and receive a partial refund from the Social Security. After 6 weeks of sick leave an employee can be dismissed.

Maternity Leave Up to 16 weeks on full pay financed by Social Security. A minimum of 3 weeks must be taken before the birth.

Paternity Leave

New fathers are entitled to 5 days paid by the employer.

Parental Leave

10 days to attend medical appointments for chronically ill or disabled children. Both parents, if employed, can also request to work part time until the child is school age.

Other Leave

3 days for marriage, or for the death of a close relative. Up to 90 days’ paid leave is provided for those called up for military service.

Medical

Turkiye has universal healthcare but many employers will provide medical insurance for employees and dependents.

Life

Not commonly provided as a separate benefit but may be covered under a pension plan.

Pension

Some employers will contribute to an additional pension.

Other

A meal allowance is a commonly provided benefit (minimum of 55TYL per day).
